When can a dismissal be unlawful?
A dismissal may be unlawful if the legal ground is missing, the procedure was not followed, required protection was ignored, or the employer did not properly document the reasons.
Do not sign in a hurry
Before signing documents, the employee should understand what the document says. Some documents confirm receipt only, while others may contain agreement, settlement or resignation wording.
Collect the documents
- employment contract and annexes;
- dismissal order and documents received from the employer;
- correspondence, schedules and internal notices;
- pay slips and evidence of unpaid amounts;
- medical or protected-status documents, if relevant.
Deadlines in employment disputes can be short. Legal review should happen as soon as the dismissal order is received.
Possible claims
Depending on the case, the employee may seek recognition that the dismissal is unlawful, reinstatement, compensation for unemployment caused by the dismissal and correction of employment records.
